Key Legal Issues I Should Be Able to Address.

1. Violation of Due Process & Constitutional Rights – The fact that I was interviewed without legal representation is a direct violation of Spanish constitutional law. Additionally, the criminal case against me was referenced in a public EU document on SLAPP litigation.  This raises concerns about judicial transparency and potential legal manipulation. I discovered that document in September 2024, passed it to the criminal defence lawyer and by 30th October 2024, the defamation case was dismissed.

2. Failure of Legal Representation – The free public-appointed lawyers failed to protect my rights and disregarded my instructions. The only paid lawyer neglected key legal strategies like filing a counterclaim. The fact that one free public lawyer sent instructions to the Court in a letter that contained discriminatory grounds is alarming and strengthens the argument for legal malpractice. Article 6 violation, no fair hearing, as well as discrimination on the grounds of language and socioeconomic situation part of the anti-discrimination laws of Spain. (2022)

Bad Faith Negotiations

3. Breach of Contract & Bad Faith Negotiations—The recorded verbal agreement of September 2020 and signed contract of July 2021 regarding the financial settlement and property should have been presented in court. An appeal of the Civil Court decision on the “precarious” eviction failed because the free public-appointed lawyer did not allow evidence into the court. My free legal advice via Gender Violence Organisation in 2021 was to negotiate yet “negotiations” are forbidden. Article 44, paragraph 5, of Organic Law 1/2004 expressly prohibits mediation in cases of intimate partner violence that come before specialist violence against women court.

Under Spanish law, agreements must be made in good faith, and the shifting terms of the settlement by the former partner (in mediation and negotiations) while under financial and eviction pressure point to coercion. This could be challenged legally.

4. Denial of Basic Living Conditions & Human Rights Violations—The lack of fresh running water and sanitation since June 2023 is unacceptable. Access to fresh water and sanitation are internationally recognised human rights, Article 11 (1). It could be argued that it amounts to inhumane treatment under European and international human rights law, Article 16. Additionally, denying a metered water supply and second occupation license raises administrative and legal concerns that should be addressed.

Other Legal Issues.

The system of Justice is not always straightforward, and when survivors are failed over and over again, it creates an unbearable trauma of injustice and betrayal.

Unfortunately, money is power. Without the financial means to support good legal representation, survivors will continue to be failed.
